Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Right Size Care website and the free tools and content offered on it (together, the “Services”). The Services are operated by The Good Studio LLC (Wyoming) and Strategic Database Systems (Delaware) (together, “Right Size Care,” “we,” “us,” or “our”). Please read these Terms carefully.
By using the Services, or by checking a box indicating that you agree to these Terms, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Who may use the Services
You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a community or organization, you represent that you are authorized to accept these Terms on its behalf.
2. What the Services are
The Services include informational content and free, educational self-assessment tools, including the Survey-Readiness Score and the Census & Revenue Leak Calculator. The tools generate results based only on the information you enter and on general, publicly available concepts.
3. Not professional advice; no guarantee
The Services are provided for general educational and informational purposes only. They are not legal, regulatory, compliance, medical, clinical, accounting, tax, financial, or other professional advice, and they do not create any professional relationship.
- Right Size Care is not a government agency and is not affiliated with, endorsed by, or acting on behalf of any state licensing or survey body.
- No result, score, estimate, or suggestion is a prediction, assurance, or guarantee of any survey outcome, citation, financial result, occupancy level, or revenue.
- You are responsible for verifying all requirements with your state licensing agency and for consulting qualified professionals before making decisions. You use the Services and any output at your own risk.
4. AI-assisted features
Some output is generated with the help of artificial intelligence. AI output can be inaccurate, incomplete, or out of date, and is not a substitute for professional judgment. You are solely responsible for reviewing and independently verifying any output before relying on or acting on it. We are not responsible for any decision made in reliance on AI-assisted output.
5. No resident or health information
The tools ask only about your processes and facility-level numbers. Do not submit any resident, patient, or protected health information through the Services. You are responsible for ensuring that anything you submit does not contain such information.
6. Acceptable use
You agree not to:
- use the Services for any unlawful purpose or in violation of these Terms;
- copy, scrape, harvest, reverse engineer, or attempt to derive the underlying code or data;
- interfere with, disrupt, or place undue load on the Services or their security; or
- misrepresent your identity or submit false information.
7. Intellectual property
The Services, including their design, text, tools, logic, and content, are owned by Right Size Care or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own internal, non-commercial evaluation. Any downloadable materials we provide may be used for your own internal purposes and may not be resold or redistributed.
8. Third-party links and services
The Services may link to or rely on third-party websites and services that we do not control. We are not responsible for their content, policies, or practices, and your use of them is at your own risk.
9. Disclaimer of warranties
THE SERVICES AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE OR RELIABLE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RIGHT SIZE CARE AND ITS OWNERS, MEMBERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Right Size Care and its owners, members, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.
12. Changes and availability
We may change, suspend, or discontinue any part of the Services at any time without notice. We may also update these Terms from time to time. Changes are effective when posted, and your continued use of the Services means you accept the updated Terms. The “Last updated” date above shows the current version.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction. We encourage you to contact us first so we can try to resolve any concern informally.
